Terms Of Service

These Terms of Service ("Terms") govern your access to and use of shop.jumpstartmd.com and any related services, features, content, and purchases made through the online store (collectively, the "Store"). The Store is operated by JumpstartMD, Inc. ("JumpstartMD," "we," "us," or "our"). The Store sells retail wellness products and is separate from JumpstartMD's clinical services. Medical care, clinical consent, and membership are governed by the separate JumpstartMD Clinical Agreement and Membership Agreement, not by these Terms.
By accessing or using the Store, or by purchasing products through the Store, you agree to be bound by these Terms. Where the Store presents these Terms for acceptance at account creation or checkout, your affirmative acceptance constitutes your agreement. If you do not agree, please do not use the Store.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Store or make a purchase through the Store. The Store is intended for use by residents of the United States.
2. Store Purpose
The Store offers wellness and retail products for purchase online. Products sold through the Store are intended for personal use only and not for resale unless expressly authorized by JumpstartMD.
3. No Medical Advice
The content made available through the Store, including product descriptions, educational content, recommendations, and marketing materials, is provided for informational purposes only and does not constitute medical advice, diagnosis, or treatment.
Purchasing a product from the Store does not create a provider-patient relationship with JumpstartMD and does not replace consultation with a qualified healthcare professional. You should consult your physician or another qualified healthcare provider before starting any supplement or wellness product, especially if you are pregnant, nursing, have a medical condition, or are taking medications.
For any dietary supplement offered through the Store, the following applies: these statements have not been evaluated by the Food and Drug Administration, and the product is not intended to diagnose, treat, cure, or prevent any disease.
4. Product Information and Availability
We strive to ensure that product descriptions, images, pricing, availability, and other product-related information are accurate. However, we do not guarantee that all information on the Store is complete, current, or error-free.
We reserve the right to:
- correct errors, inaccuracies, or omissions
- change or update product information at any time
- modify or discontinue products without notice
- limit product quantities
- restrict sales to any person, geographic region, or jurisdiction where permitted by law
5. Orders
Your submission of an order constitutes an offer to purchase products from JumpstartMD. We reserve the right to accept, reject, limit, or cancel any order in our sole discretion, including due to product or inventory availability, pricing or content errors, suspected fraud or misuse, violations of these Terms, or operational or legal reasons. If we cancel an order after payment has been submitted, we will issue a refund in accordance with Section 8 (Shipping, Returns, and Refunds) below.
6. Pricing and Payment
All prices are listed in U.S. dollars unless otherwise stated. Applicable taxes, shipping charges, and other fees will be displayed during checkout. By submitting payment information, you represent that you are authorized to use the payment method provided and that your billing information is accurate and complete. Payments are processed by third-party payment service providers, and we do not store full payment card information on our own systems.
7. Subscriptions and Recurring Orders
If the Store offers subscription or recurring purchase options, those purchases are subject to our Subscription Policy, which is incorporated into these Terms by reference. By selecting a subscription option, you agree to the applicable recurring billing, renewal, cancellation, and management terms described in the Subscription Policy. Recurring charges require your separate affirmative consent to the automatic-renewal terms at checkout, and you may cancel as described in the Subscription Policy, including online if you enrolled online.
8. Shipping, Returns, and Refunds
Shipping timelines provided through the Store are estimates only and are not guaranteed. We reserve the right to limit or deny returns, refunds, or replacements where permitted by law and consistent with our stated policies.
The Store ships retail wellness and supplement products only. Prescription and compounded medications are provided through JumpstartMD's clinical services, not the Store, and are not shipped or returned under these Terms.
Shipping
We currently ship within the United States only. Standard shipping is free on all orders, and expedited options may be offered at checkout, if available.
Orders are typically processed within one to two business days. Once your order ships, you will receive a confirmation email with tracking information. Estimated delivery times are provided at checkout and are estimates only, and may vary based on your location, carrier delays, holidays, or other circumstances outside our control.
Please ensure your shipping address is accurate before submitting your order. JumpstartMD is not responsible for delays or additional costs resulting from an incorrect or incomplete address provided at checkout.
Title and risk of loss pass to you when your order is delivered to your address. If tracking shows delivery but you have not received your order, or a package appears lost or stolen, contact Customer Support within seven (7) days and we will work with the carrier to help resolve it.
You may request to change or cancel an order before it ships by contacting Customer Support. Once an order has shipped, the returns and refund terms below apply.
Returns and Refunds
Because our supplements are ingestible health products, we do not accept returns once an order has shipped, which protects the safety and integrity of the products we provide.
Please inspect your order upon delivery. If you receive a damaged product, an incorrect item, or a product that appears defective, contact Customer Support within seven (7) days of delivery with your order number and photographs of the issue. Depending on the situation, we may provide a replacement, store credit, or refund at our discretion.
Refunds are generally not available once an order has shipped. If you experience an issue with your order, contact Customer Support and we will review the request on a case-by-case basis to determine whether a replacement, store credit, or refund is appropriate. Approved refunds are issued to the original payment method, and depending on your financial institution may take several business days to appear.
Nothing in these Terms limits any non-waivable refund or warranty right you may have under the law of the state where you reside.
Subscription Orders
Some products are offered as recurring subscriptions. Renewal, changes, and cancellation of subscriptions are governed by the Subscription Policy. As with all orders, once a subscription order has been processed or shipped, it is subject to the returns and refund terms above.
9. Promotions, Discounts, and Store Credits
Promotions, discount codes, store credits, bundled offers, and other special pricing may be subject to additional terms and conditions. Such offers may be modified, suspended, or discontinued at any time without notice, unless otherwise required by law. Promotions may not be combined unless expressly stated.
10. Accounts and Security
If account creation or login functionality is made available through the Store, you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to provide accurate, current, and complete information and to notify us promptly of any unauthorized use of your account or any other breach of security.
11. Acceptable Use
You agree not to:
- use the Store for any unlawful purpose
- interfere with or disrupt the Store or its systems
- attempt to gain unauthorized access to the Store, accounts, or networks
- copy, scrape, reproduce, distribute, or exploit Store content for commercial purposes without authorization
- submit false, misleading, or fraudulent information
- use the Store in a way that violates applicable laws or regulations
12. Intellectual Property
All content on the Store, including text, graphics, images, product names, logos, page designs, software, and other materials, is owned by or licensed to JumpstartMD and is protected by intellectual property laws. Except as expressly permitted by these Terms, you may not use, reproduce, modify, distribute, display, publish, or exploit any Store content without our prior written consent.
13. Third-Party Services and Links
The Store may include or rely on third-party services, tools, and integrations, including payment processors, subscription providers, fulfillment providers, analytics providers, and other service partners, and may contain links to third-party websites. We are not responsible for third-party websites, services, or content, and your use of those services may be governed by their own terms and policies.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Store and all content, products, and services made available through it are provided on an "as is" and "as available" basis. JumpstartMD disclaims all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Store will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
Nothing in these Terms disclaims or limits any warranty or right that cannot be disclaimed or limited under applicable law, including the implied warranty of merchantability to the extent it cannot be disclaimed on consumer goods under the California Song-Beverly Consumer Warranty Act, and nothing here excludes or limits liability for personal injury caused by a defective product.
15. Limitation of Liability
To the fullest extent permitted by law, JumpstartMD and its affiliates, officers, directors, employees, agents, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of or inability to use the Store, your purchase or use of products from the Store, errors, interruptions, or delays in Store operation, or unauthorized access to or alteration of your information. To the fullest extent permitted by law, JumpstartMD's total liability for any claim arising out of or relating to the Store or any purchase will not exceed the amount you paid for the specific product giving rise to the claim.
Nothing in these Terms limits liability for JumpstartMD's own fraud, gross negligence, or willful injury, for violation of law, for personal injury caused by a defective product, or for any other liability that cannot be limited under applicable law (California Civil Code §1668).
16. Indemnification
You agree to indemnify, defend, and hold harmless JumpstartMD and its affiliates, officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to your violation of these Terms, your misuse of the Store, or your violation of any law or the rights of a third party.
17. Dispute Resolution; Binding Arbitration; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Any dispute, claim, or controversy arising out of or relating to the Store, your purchases, or these Terms, including their validity or enforceability, will be resolved exclusively by binding arbitration on an individual basis, and not by a jury or court trial or by any class or representative proceeding.
Arbitration will be administered by JAMS before a single neutral arbitrator under JAMS's applicable consumer or commercial arbitration rules, and as applicable the Federal Arbitration Act (9 U.S.C. §§1–16) or the California Arbitration Act. Arbitration will take place in the California county of your residence or another mutually agreed location. You pay only the filing fee provided under the administrator's consumer rules, and JumpstartMD pays the remaining arbitration fees to the extent those rules require.
Class action waiver. You and JumpstartMD agree to bring claims only in an individual capacity and not as a class member or representative, and the arbitrator may not consolidate claims or conduct class or representative arbitration. If the class-action waiver is found unenforceable as to any claim, that claim will be severed and heard in court, and the remainder of this arbitration provision will remain in effect.
Public injunctive relief. Nothing in these Terms waives the right to seek public injunctive relief. A claim for public injunctive relief is not subject to arbitration and may be brought in court (California Civil Code §3513; McGill v. Citibank).
Opt-out. You may opt out of this arbitration provision within 30 days of first accepting these Terms by sending written notice, including your name and address, to JumpstartMD, 350 Lorton Avenue, Burlingame, CA 94010.
Scope. This provision governs disputes arising from the Store and store purchases. Claims of medical malpractice or professional negligence are governed by the arbitration provision in the JumpstartMD Clinical Agreement, and membership disputes are governed by the JumpstartMD Membership Agreement.
18. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict of law principles.
For any dispute not subject to arbitration, or if the arbitration provision is held unenforceable, the state and federal courts located in California will have exclusive jurisdiction and venue, unless applicable law provides otherwise.
19. Changes to These Terms
We may update these Terms from time to time. If we do, we will post the revised Terms on this page and update the Effective Date above.
For non-material changes, your continued use of the Store after the revised Terms are posted constitutes acceptance. For material changes, including any change to the arbitration provision, we will provide reasonable advance notice and, where required by law, obtain your affirmative acceptance before the change applies to you.
20. General
Severability. If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will remain in full force.
Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
Waiver. Our failure to enforce any provision is not a waiver of that provision.
Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
Entire agreement. These Terms, which include the shipping, returns, and refund terms in Section 8, together with the Subscription Policy and the Privacy Policy incorporated by reference, are the entire agreement between you and JumpstartMD regarding the Store.
